How long can you use paper logs after an ELD malfunction? ›

Recording RODS on a paper log cannot continue for more than 8 days after the malfunction unless an extension is given in accordance with § 34 – ELD Malfunctions and Data Diagnostic Events.

A driver may restart a 7/8 consecutive day period after taking 34 or more consecutive hours off duty. The truck driver 34-hour reset is a way for drivers to reset their workweek and 60/70 hour clock by taking 34 consecutive hours off work, either spent off-duty or in the sleeper berth.

Can a user edit or change driving time that has been recorded by an electronic logging device (ELD) to non-driving time? No. An ELD automatically records all of the time that a CMV is in motion as driving time that cannot be edited or changed to non-driving time.

Additional categories of ELD exemptions

Short-Haul Exemption: Drivers within a 150 air-mile radius returning within 14 hours may be exempt. Agricultural Exemption: Certain agricultural operations, especially during planting and harvesting seasons. Pre-2000 Exemption: Vehicles with engines predating the model year 2000.

Guidance: Both a driver and authorized carrier staff can make limited edits to an ELD record to correct mistakes or add missing information. However, under 49 CFR 395.30(d)(2), authorized carrier staff cannot request edits before the records have been submitted by the driver.

Though various drivers can use the same ELD, each driver should have their credentials. This is an important aspect of maintaining accurate records of individual driving hours and activities. As per FMCSA rules and regulations, each driver is responsible for certifying their logs.

To use personal conveyance, the driver must first be in “Off-Duty” driving status in their ELD or HOS logbook. For example, if an off-duty driver takes their truck to their home from a terminal location, then they can use personal conveyance as soon as the driver goes to Off-Duty and then leaves the terminal location.

(1) Effective January 1, 2024, a A motor carrier operating commercial motor vehicles shall install and shall require each driver to use an Electronic Logging Device (ELD) to record the driver's RODS.

Drivers with 8 days of RODS or less: Drivers who use Records of Duty Status (RODS) for 8 days or less in any 30-day period, are also exempt from using electronic logging devices. If a driver doesn't frequently go over the 8 days of RODS, they can use an ELD on demand for the times they do.

As specified in the ELD rule, the following are not required to use ELDs (but carriers may choose to use ELDs even if they are not required): Drivers who use paper logs no more than 8 days during any 30-day period.

California is falling in line with the Federal Motor Carrier Safety Administration (FMCSA) ELD mandate for interstate motor carrier(s) and interstate driver(s) and will require intrastate commercial drivers to use ELDs instead of paper logbooks, starting on January 1, 2024.

Drivers who operate under the short-haul exceptions may continue using timecards; they are not required to keep RODS and will not be required to use ELDs. Drivers who use paper RODS for not more than 8 days out of every 30-day period.

Records of duty status must be maintained, with all supporting documents, for a minimum of 6 months.
